Definitions
From 13th December 2023,
Compulsory Ticket Area means any part of the passenger transit system identified by a notice stating that no person may enter there without being in possession of a valid Ticket.
Conditions means these Conditions of Carriage.
DART Byelaws means the London Luton Airport Passenger Transit System Byelaws 2021 which come into force on 10 March 2023.
DART Carriage means each vehicle used for the carriage of passengers and forming part of the DART passenger transit system. DART Network means all parts of the DART system where members of the public are allowed to go including the applicable parts of the DART Stations, DART Carriages and passenger embarkation and disembarkation areas.
DART Partner means a DART appointed authorised retailer of DART only QR barcode Tickets.
DART Staff means any person acting in the course of that person’s duties who (i) is an employee, agent, contractor, or sub-contractor of the Operator; or (ii) is authorised by the Operator.
DART Station means a station, its passenger embarkation and disembarkation areas, associated public spaces and pedestrian and vehicular access ways forming part of the DART passenger transit system, located at London Luton Airport or at Luton Airport Parkway as the case may be.
GTR means Govia Thameslink Railway Limited (No. 07934306) whose registered office is 3rd Floor, 41-51 Grey Street, Newcastle upon Tyne, Tyne and Wear, NE1 6EE.
Licensed Retailer means an organisation authorised and licensed to sell Tickets by a National Rail Train Company or the Rail Delivery Group.
LLAL means London Luton Airport Limited (trading as Luton Rising).
National Rail Network means the network of railway lines over which National Rail Train Companies operate scheduled passenger railway services.
National Rail Services means scheduled passenger train services provided by National Rail Train Companies.
National Rail Train Company means a company operating passenger railway services through the National Rail Network.
Operator means (i) LLAL; or (ii) any person or body granted the authority by LLAL to act as operator in relation to any part of the passenger transit system.
TfL means Transport for London.
Ticket means any physical or electronic document or record which entitles a passenger to make a journey on DART services, or combined DART services and National Rail Services subject to and in accordance with these Conditions.
TTL means Transport Trading Limited (No. 03914810) whose registered office is 5 Endeavour Square, London, United Kingdom, E20 1JN.
- Introduction
- These Conditions comprise the binding contract that comes into effect between you and LLAL when you purchase or otherwise acquire a Ticket. They govern your rights and duties as a passenger on the DART Network and apply while you are on any part of the DART Network.
- Your rights and duties set out in these Conditions do not affect your rights and duties under the DART Byelaws.
- While on any part of the DART Network you must comply with the DART Byelaws.
- In these Conditions "we" and "us" means LLAL and "you" and "your" means any passenger on the DART Network.

- Services and safety
- From time to time, it may be necessary to replace DART services with a bus or coach. In most cases this is planned in advance (for example due to engineering work to maintain or improve the DART Network), but sometimes such changes may be required at short notice. Usually, such replacement bus and coach services will take longer than the scheduled time for the equivalent DART service.
- These Conditions apply to the use of any bus and coach services that replace DART services.
- We are not liable for any costs incurred or losses suffered as a result of any delays or interruption to the DART service (including the use of replacement bus and coach services). We reserve the right to stop the DART service (including any replacement bus and coach services) from running without providing any prior notice.
- In respect of coronavirus or other infectious diseases, all passengers over the age of 11 years may be required to wear a face covering while on any part of the DART Network. If you are instructed to use a face covering, your face covering must cover from the top of your nose to the bottom of your chin and attach behind your ears or tie behind your head, unless you are exempt from this requirement.
- You must not engage in anti-social or criminal behaviour when you are on any part of the DART Network. You must comply with the provisions relating to anti-social and criminal behaviour that are set out in the DART Byelaws, which apply to anyone while they are on any part of the DART Network.
- Requirement to have a Ticket
- You may only buy your DART or combined DART and National Rail Ticket as set out below (otherwise it will not be valid):
- from a DART Partner via the Luton DART website at www.lutondart.com (this system will issue a DART only QR barcode Ticket); or
- from a Licensed Retailer on the same basis as tickets for travel on National Rail Services are available for retail, including via:
- National Rail ticket offices;
- websites or mobile apps;
- self-service ticket vending machines;
- any smart ticketing scheme that any relevant National Rail Train Company participates in (but excluding pay as you go); and
- rail appointed travel agents; and
- You may only buy your DART or combined DART and National Rail Ticket as set out below (otherwise it will not be valid):
- on the same basis as tickets for travel on TfL’s services are available for retail.
- Once you have bought your Ticket(s), you should check that you have the correct Ticket(s). If you think a mistake has been made by an official retailer that sold you the Ticket(s), you should tell them as soon as possible.
- Some Tickets entitle you to services from third parties, for instance the right to travel on DART and National Rail Services. Where this is the case, your Ticket is also evidence of a contract between you and that other party, whose own terms and conditions (including their conditions of carriage or conditions of travel) will apply when using their services. For example:
- your rights and responsibilities when travelling on the National Rail Network are set out in the National Rail Conditions of Travelat www.nationalrail.co.uk/times_fares/conditions-of-travel.aspx; and
- your rights and responsibilities when using TfL’s services are set out at https://tfl.gov.uk/corporate/terms-and-conditions/ticketing-and-travel-conditions-of-carriage
- GTR, TTL, the National Rail Train Companies and any Licensed Retailer of a DART Ticket are not responsible for any journey made or intended or attempted to be made by any person on any of the DART services nor for any:
- delays, cancellations or other disruptions to a journey on the DART services; and/or
- loss or damage however arising which that person may suffer in relation to the provision or non-provision of the DART services.
- Except as provided in paragraph 4(h) of these Conditions, you must have a valid Ticket or general travel authority before you enter, and while you are in, a Compulsory Ticket Area.
- Except as provided in paragraph 4(h) of these Conditions, you must have a valid Ticket or general travel authority before you board, and while you are in, a DART Carriage.
- You must look after your Ticket or general travel authority and produce it when asked to do so by DART Staff. If a Ticket is damaged to the extent that it is not legible and cannot (where applicable) be scanned or otherwise validated, it will not be valid for travel.
- You are not required to have a Ticket or a general travel authority before you enter, or while you are in, a Compulsory Ticket Area or before you board a DART Carriage, if:
- there is no means of purchasing a Ticket at a DART Station before your journey on the DART begins;
- there is a notice at the DART Station where your journey on the DART begins stating that passengers may travel on the DART without a Ticket;
- DART Staff have given you permission to travel on the DART without a Ticket;
- you have a disability and Ticket purchasing arrangements at the DART Station from which you wish to depart are not suitably accessible to enable you to buy a Ticket; or
- you are a child under five years of age who is travelling with a passenger holding a valid Ticket.

- Discounts on the DART portion of combined DART and National Rail Tickets do not apply, e.g. National Rail Railcards products, unless otherwise expressly stated by LLAL from time to time.
- The DART portion of a Ticket is valid on the DART Network only. A Ticket is valid only for the direction of travel described on the Ticket. You must use your Ticket on or within the date(s) that it is valid. The date(s) of validity will be made clear on your Ticket, or when you buy your Ticket.
- DART only QR barcode Tickets are non-transferrable and non-refundable unless DART services are unable to run and alternative transport has not been provided.
- Combined DART and National Rail Tickets may be subject to the rules on refunds and/or compensation payments contained in the National Rail Conditions of Travel, TfL's terms and conditions (including TfL’s Conditions of Carriage) and/or any Passenger Charter if services are disrupted, or unable to run. This will depend on the National Rail Train Company responsible and how you purchased your Ticket. The National Rail Conditions of Travelcan be found at nationalrail.co.uk/times_fares/conditions-of-travel.aspx and the terms and conditions applicable to TfL’s services can be found at tfl.gov.uk/corporate/terms-and-conditions/ticketing-and-travel-conditions-of-carriage.
- You must not forge, alter, or deface a Ticket in any way. A Ticket which has been forged, altered, or defaced in any way is not valid for travel on the DART Network. Should you be found to be in possession of a forged, altered, or defaced Ticket we may ask you to leave the DART Network and/or refer the matter to the police.
- A Ticket may only be used by the person who bought the Ticket or on whose behalf it was bought.
- Children under five years of age may travel on the DART Network free of charge without a Ticket if they are travelling with a passenger holding a valid Ticket. Children aged between 5 years and 15 years must have a valid Ticket for travel on the DART Network but are entitled to a “child” discount at 50%.
- If you are eligible for a DART concessionary scheme and if you have registered online via the Luton DART websiteat lutondart.com then you may purchase or acquire, at a reduced rate, a concession Ticket via the Luton DART website concession site at www.lutondart.com. You must have an eligible and valid form of personal identification in order to register and this must be shown, if requested, when you are on any part of the DART Network.
- Penalty fares
- If you enter a Compulsory Ticket Area or a DART Carriage without a valid Ticket (except in the circumstances described in paragraph 4(h) of these Conditions), you may be charged a penalty fare of £25 and be liable to prosecution under the DART Byelaws.
- If you are unable to present a valid Ticket or to pay a penalty fare of £25, you may be required to provide your name and address so that the matter can be followed up.
- It is an offence under the DART Byelaws if you fail to provide your name and address when requested in the circumstances described in the DART Byelaws.
- If you are in charge of any motorised mobility scooter, bicycle or other conveyance used, left or placed in breach of the DART Byelaws you may be liable to pay a penalty in accordance with the DART Byelaws.
- You may also be liable to pay other penalties in accordance with the DART Byelaws.
- Luggage, Cycles and Possessions
(a) You may bring with you onto the DART Network:
(i) Personal luggage that you are able to carry yourself, including up and down stairs;
(ii) Prams, pushchairs, buggies, disability and mobility scooters and wheelchairs; and
(iii) Any other item provided it is not dangerous or likely to injure or obstruct anyone.
(b) You may bring with you onto the DART Network:
(i) Traditional and folding bicycles and traditional and folding scooters;
(ii) Electric-assist pedal bicycles that are similar in size to a traditional bicycle, provided that, when on the DART Network, you do not ride or otherwise use these bicycles and scooters and provided that you fold any folding bicycle and folding scooter.
(c) You must not bring onto the DART Network petrol powered scooters, electric powered scooters (e-scooters), e-unicycles, e-skateboards, hoverboards and any other recreational mobility devices powered by lithium-ion batteries, other than disability and mobility scooters and wheelchairs.
(d) You must not bring onto the DART Network anything that:
(i) Is not in a proper container or packaging where it should be in a container or packaging;
(ii) Would obstruct the doors of a DART Carriage so as to delay its departure or the embarkation or disembarkation of passengers;
(iii) You are unable to carry yourself including up and down stairs;
(iv) Is hazardous, flammable, or dangerous in any way; or
(v) Is likely to cause injury or offence to DART Staff or passengers.
(e) You must keep your luggage and anything else you bring onto the DART Network with you at all times. Luggage must be safely stowed on board, and must not block any entrance to and exit from a DART Carriage. Any luggage or anything else that you bring onto the DART Network that is left unattended will be removed or disposed of and treated according to these Conditions.
(f) DART Staff can refuse permission for you to take any item onto the DART Network. If you are not sure if a particular item will be allowed, please contact us for advice before you travel.
(g) Only Hand luggage is permitted to be carried on our escalators. Larger items such as Buggies, Scooters, Bikes, Electric bikes, Large or Heavy Suitcase must be carried onto our lifts.
- Accessibility
- We want to ensure that the DART Network is accessible to everyone. Should you enter a DART Carriage in a wheelchair or with a buggy or pushchair you must ensure it is safely positioned within the DART Carriage and properly secured.
- You may bring an assistance animal onto the DART Network without charge.
- Animals
- You must comply with the provisions relating to travel with animals on the DART Network that are set out in the DART Byelaws.
- You may bring with you any dog or other small animal onto the DART Network, but it must:
- be on a leash or otherwise be suitably controlled; and
- not be left unattended.
- You will be held responsible for the actions of your animal.
- DART Staff may refuse entry to any animal which, in the reasonable opinion of the Operator or DART Staff, may (a) be dangerous, (b) threaten or annoy any other person or (c) foul, soil or damage any part of the DART Network.
- If you are not sure if your animal will be allowed to travel, please contact us for advice before you travel.
- Lost Property
- You are responsible for any luggage and other items you bring onto the DART Network, and we are not responsible for any loss or damage to it.
- If you lose any property on the DART Network, please complete a lost property form which is available on the Luton DART website at www.lutondart.com using the contact us form and send it to us via the contact us form or post it to us at the above address.
- If property is left in a DART Carriage or anywhere on the DART Network, we have the right to open it and examine the contents before removing it to a secure place or disposing of it. We may, without being liable, remove or dispose of any property, which might in our opinion cause loss or damage to property or death or personal injury or inconvenience to DART Staff or passengers.
- Lost property found by DART Staff or handed in to DART Staff will be kept for a maximum of 1 month.
- If we are able to identify that an item reported by you (via the Luton DART website at www.lutondart.com using the contact us form) as lost has been handed in to us we will email you (if you have provided your email address via the contact us form) notifying you that we believe the item has been handed in.
- Lost bank cards, including credit cards, will not be held for longer than 24 hours and after that time will be destroyed and disposed of.
- Lost passports and driving licences will be returned to the issuing office after a period of 3 days unless we are contacted by you via the contact us form on the Luton DART website within 3 days and we agree alternative arrangements with you.
- We are not responsible for any costs incurred by you in collecting lost property or in having lost property returned to you whether or not the item held is in fact your lost item.
- We may make a charge (not exceeding £5 per day per item and not exceeding a total amount of £100 per item) for storing property and for retrieval of property by the owner depending on:
- the type of property; and
- the period for which it has been kept.
- Any property which has not been claimed by the owner within one month may be sold or otherwise disposed of and any money from any sale may be retained by us. Items which are perishable may be disposed of earlier.
